1. Agreement to Terms
By accessing or using the TubiTow mobile application, website, or any related services (collectively, the “Platform”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Platform.
TubiTow is operated by TubiTow LLC (“TubiTow,” “we,” “us,” or “our”). These Terms apply to all users, including customers requesting roadside assistance and independent tow operators providing services through the Platform.
2. Platform Description
TubiTow is a technology marketplace that connects motorists in need of roadside assistance with nearby, independent, verified tow truck operators. Services available through the Platform include towing, jump starts, lockouts, tire changes, fuel delivery, and winch-outs.
TubiTow is not a towing company. We do not own, operate, or control any tow trucks or roadside assistance vehicles. Tow operators on the Platform are independent contractors and are not employees, agents, or representatives of TubiTow.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using TubiTow, you represent and warrant that you meet these requirements.
4. Account Registration
To use certain features, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
5. Pricing & Payments
Pricing is displayed upfront before you confirm a service request. Prices are based on service type, vehicle class, and distance. All payments are processed securely through the app. By confirming a request, you authorize TubiTow to charge your payment method for the quoted amount.
TubiTow retains a platform commission (approximately 20%) from each completed job. The remaining amount is paid to the tow operator.
6. Cancellations
You may cancel a service request at no charge before a driver is dispatched. Cancellations made after a driver has been dispatched may be subject to a cancellation fee, which will be clearly displayed in the app before you confirm cancellation. See our Refund & Cancellation Policy for full details.
7. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Interfere with or disrupt the Platform or its servers
- Impersonate any person or entity
- Submit false, misleading, or fraudulent service requests
- Harass, threaten, or abuse any operator or other user
- Attempt to circumvent the Platform’s payment system
8. Independent Contractors
Tow operators using the Platform are independent contractors. TubiTow does not control the manner or method by which operators perform services. Operators are solely responsible for their own licensing, insurance, equipment, and compliance with applicable laws and regulations.
9. Limitation of Liability
To the maximum extent permitted by law, TubiTow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to property damage, personal injury, or loss of data. TubiTow’s total liability shall not exceed the amount you paid for the specific service giving rise to the claim.
10. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. TubiTow does not guarantee the availability, timeliness, quality, or suitability of services provided by operators.
11. Indemnification
You agree to indemnify and hold harmless TubiTow, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.
12. Dispute Resolution
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Georgia. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
